Art. 2 Within the scope of the ANS, the administrative proceedings initiated to determine the violation of the legal provisions or infra legal provisions that regulate the supplementary health market, which may result in the application of administrative sanctions, shall be governed by the provisions of this Normative Resolution.
Single paragraph. The provisions of Law No. 9,784, of January 29, 1999, which regulate the administrative process within the scope of the Federal Public Administration, are subsidiarily applied to the administrative process referred to in this Resolution.
Art. 3 The acts and procedural terms provided for in this Resolution will contain only what is essential for its purpose, without blank spaces, between the lines, erasures and amendments without exception.
§ 1 The deadlines begin to run from the date of the official notice, starting counting on the first subsequent business day and including the expiration date.
§ 2 The term is considered to be extended until the first following business day if the due date falls on a day when there is no working day or it ends before normal time
§ 3 The terms expressed in days are counted continuously; the deadlines set in months or years are counted from date to date. If in the month of maturity there is no day equivalent to that of the beginning of the term, the last day of the month ends.
§ 4 In the practice of procedural acts, the principle of speed and procedural economy will be observed, not allowing requirements that are not strictly necessary to elucidate the matter.
§ 5 ° The interested party will accompany the administrative procedure, being able to have a view of the records, in the division, as well as to extract copies of them, upon payment of the corresponding expense, in the form of the specific regulation.
§ 6 The procedural acts may be totally or partially digital, in order to allow them to be produced, communicated, stored and validated by electronic means, in accordance with the regulations. (Included by RN nº 444, from 01/01/2019)
§ 7 In the absence of a legal precept or a term determined in the sectorial regulation, the period for the practice of a procedural act to be carried out by the operator shall be 5 (five) working days. (Included by RN nº 444, from 01/01/2019)
